Marines T-shirt a no-no at Illinois school

A father wants an Illinois school district to rethink its dress code after his 14-year-old son was threatened with suspension if he did not remove his U.S. Marines T-shirt.

According to FoxNews.com, Daniel McIntyre, 44, said his son was told by teacher Karen Deverell during reading class at Genoa-Kingston Middle School on Monday that his shirt violated the dress code because it shows two interlocking guns. He was then asked to wear the shirt inside out or face possible suspension.

Deverell did not inform school officials of the incident, but when asked about the school dress policy, Genoa-Kingston Superintendent Joe Burgess told FoxNews that the T-shirt was not a violation. He added that the policy simply requires kids to dress in a ?neat, clean and well-fitting manner,? and avoid wearing gang symbols or clothing that promotes ?violent behavior.? The code does not specifically ban images of guns.

?My son is very proud of the Marines and, in fact, of all the services,? McIntyre said. ?So he wears it with pride. There are two rifles crossed underneath the word ?Marines? on the shirt, but to me that should be overlooked. It?s more about the Marines instead of the rifles.?

A school statement obtained by FoxNews.com reads in part, ?The administration and school handbook agree that this shirt is not a violation of the dress code. We also take school safety very earnestly and it needs to be recognized that is a topic that we also take very seriously and support our students and staff in providing a safe environment to learn, teach and work in on a daily basis.?

?This is not right," said McIntyre. "This policy that they have in place can obviously be loosely interpreted, so they need to change it.?

Shell Oil Cancels 2013 Arctic Drilling. Now What?

It's no surprise, but now it's official: Shell oil announced that it will not be drilling for oil north of the Alaska coast in 2013. The company bored preliminary holes in the fall of 2012 in preparation for drilling a series of exploratory wells this summer. The idea was to become the first company to find significant oil in America's slice of the Arctic Ocean, and open up a whole new energy frontier. That plan will have to wait.

The company's Kulluk oil rig, which ran aground in the Gulf of Alaska on New Year's Eve, still needs to be transported to Dutch Harbor in the Aleutian Islands before it can begin its journey to an Asian shipyard for repairs. The Noble Discoverer drillship, Shell's second rig, is even more troubled. A few days ago, the Coast Guard referred its investigation into violations onboard the ship to the Department of Justice for potential prosecution.

It's been a rough week for the oil industry, overall. The energy news is all about the BP oil spill trial, opposition to the Keystone XL pipeline, and investigations into Shell's drilling program. The stories share some DNA. In recent years, we've seen increasing focus on hard-to-get oil, crude that you can't extract from shallow water or from easy-to-access wells in the desert. That's why we have deep-water drilling, rising output from the oil sands of Alberta, and exploration in the Arctic Ocean: The age of easy oil is waning. These alternative sources of oil are resulting in growing production and even faster-rising estimates of domestic fossil fuel reserves. They are a big part of the future. But the technical difficulties and environmental impacts are becoming increasingly clear.

Of all those case studies of hard-to-get oil, Shell's may be the most surprising. It's simply astonishing that one of the biggest companies in the world could spend nearly $5 billion and the better part of a decade working in the region without completing a single exploratory well. Industry advocates have voiced legitimate complaints about the sometimes byzantine regulatory process, but none of that explains Shell's missteps in 2012, after its permits were essentially all in place. To cite just the most memorable problems: A barge meant to carry oil-spill response equipment had trouble passing CoastGuard inspections, and the equipment itself buckled during testing in the calm waters of Puget Sound. The Kulluk ran aground south of Anchorage once the season had ended. And then there's the Discoverer.

Last fall, when I was on the North Slope to visit the Kulluk for several days, I met a Discoverer worker who said that exploring the drillship's engine room, with its 1960s Mitsubishi engine that they dubbed Big Green, was like going into a museum. A number of the problems cited by the Coast Guard relate to the engine room and the exhaust system. The list includes such seemingly elementary mistakes as exposed wiring and this:

6. Exhaust system back-fires on regular basis. Chief engineer suspects this is due to change to exhaust system in order to accommodate helicopter deck installation. As a result of back-fires (one of which resulted in a stack fire recently),main propulsion machinery and all auxiliary machinery essential to the propulsion and safety of the unit may be compromised. (IMO MODU Code 1979 7.1.3)
Massachusetts Rep. Ed Markey, who sits on the House Natural Resources Committee,and a number of environmental groups have been calling for a review of Arctic Ocean oil exploration rules. Meanwhile, several other companies, including ConocoPhillips and Statoil, hold offshore leases in the region and have been planning to drill in the next three years. And the Department of the Interior has made public its intention to hold more lease sales in the Arctic Ocean. In light of the multiple investigations going on right now, at least some of those plans seem likely to change.

Stocks climb higher in midday trading

Stocks added to their gains Wednesday, with the S&P 500 climbing back above 1,500 and the Dow clawing back above 14,000, lifted by a batch of upbeat earnings and following a cheery pending home sales report.

The Dow Jones Industrial Average advanced, led by JPMorgan and Boeing, after posting a triple-digit gain in the previous session.

The S&P 500 and the Nasdaq also added to their gains. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, fell below 15.

All 10 key S&P sectors turned higher, led by materials and industrials.

"We're in a sideways process with the Dow around 14,000 and we'll probably be around here for a while," said Jeff Kleintop, chief market strategist at LPL Financial. "Profit and economic growth may be softer in Europe and we're probably due for a pullback, but I don't think it's going to be a big one. You want to buy into the dips and put capital to work."

On the economic front, pending home sales jumped 4.5 percent in January to 105.9, according to the National Association of Realtors, hitting its highest since April 2010. Economists in a Reuters survey expected a 1.5 percent gain compared with a 4.3 percent drop in the previous month.

Weekly mortgage applications declined for a third-consecutive week even as rates eased, according to the the Mortgage Bankers Association.

Durable goods orders declined 5.2 percent in January after gaining 4.3 percent in the prior month, according to the Commerce Department. But excluding transportation, durable goods orders increased 1.9 percent, the biggest gain since December 2011.

Flower Foods spiked after the packaged bakery goods company won the bid for Hostess' Wonder bread in a deal worth $360 million, CNBC learned.

In a busy day for retail earnings, Target posted quarterly results that topped expectations for the holiday quarter. But shares gave up their initial gains amid investor concern over the company's ability to reach its forecast, given its large-scale expansion plans in Canada.

Dollar Tree soared to lead the S&P 500 gainers after the discount retailer posted earnings and revenue that edged past expectations.

And TJX reported quarterly results that beat Wall Street expectations. In addition, the company announced a dividend hike and a new share repurchase program.

Coach jumped amid unconfirmed reports that the upscale retailer is exploring a sale of itself. Separately, the retailer said it has hired a former Nike executive to oversee the transformation of its stores.

Apple dipped ahead of the company's shareholders meeting. Shares gained in the previous session amid speculation the iPhone maker could announce plans to enhance shareholder value. Still, the stock has plunged more than 35 percent since hitting an all-time high of $705 back in September and has been trading below its 50-day moving average for nearly five months.

First Solar plunged nearly 15 percent after the solar panel maker posted revenue and outlook that fell short of Wall Street expectations. In addition, Baird cut its rating on the company to "neutral" from "outperform" and lowered its price target to $25 from $30.

Federal Reserve Chairman Ben Bernanke appeared before the House Financial Services Committee in his second day of testimony.

On Tuesday, Bernanke Bernanke said the Fed will continue its quantitative easing (QE) program until clear signs of an economic recovery are visible and also urged lawmakers to avoid sharp spending cuts due to kick in at the beginning of March.

"There was little in the way of surprise yesterday by Chairman Bernanke who, as expected, gave a stern defense of QE as an important monetary policy tool in the current crisis," wrote Derek Halpenny, European head of global markets research at the Bank of Tokyo-Mitsubishi.

European shares closed higher, thanks to a successful bond auction in Italy.

Earlier in the day, Anheuser-Busch Inbev forecast a weak start to the year in the U.S. and Brazil, after posting slightly lower-than-expected earnings in the fourth quarter of 2012. The Belgian brewer is the world's biggest beer maker and produces Budweiser and Stella Artois.

Meanwhile, Franco-German defense firm EADS predicted higher profits in 2013 as it confirmed an upswing in 2012, driven by efforts to cut costs, and strong deliveries of passenger jets. EADS shares rose by around five percent on the news. U.S. rival Boeing posted results in January that also topped expectations.

Zumba Prostitution Trial: Explicit Photos From Computer Would 'Horrify' Jury, Defense Claims

ALFRED, Maine -- The judge in the trial of an insurance agent accused of helping a fitness instructor use her Zumba studio as a front for prostitution is giving jurors a respite from testimony to address several motions, including a request to toss the remaining 13 counts.

Justice Nancy Mills must decide whether the defendant's rights trump a state law that bars release of investigators' personnel files, and she must decide how much porn jurors will see.

There's also a motion to dismiss remaining counts against Mark Strong Sr., whose lawyer have accused prosecutors of missing deadlines for turning over discovery documents in the high-profile case.

Those issues were to be discussed Tuesday morning.

Testimony on Monday focused largely on 86 items seized from Strong's Thomaston home and business in July, about five months after police raided Wright's home, studio and office in Kennebunk on Valentine's Day last year.

Saco Police Detective Frederick Williams, who reviewed seized hard drives, said Strong deleted all the email from his office computer on Feb. 15, 2012, a day after investigators raided Wrights studio, office and home.

He also said he found spreadsheets, tax documents and snapshots from Skype video chats on Strong's computer and on computer equipment belonging to fitness instructor Alex Wright, who's accused of using her Zumba studio as a front for prostitution.

Jurors weren't told of sexually explicit images on Strong's computer that prosecutors contend show he knew about the prostitution. The defense said showing the panel the more than 500 photos would be prejudicial.

"It's going to horrify some of these people to the point (Strong) is not going to be able to get a fair verdict," defense lawyer Daniel Lilley told the judge while the jury was out of earshot.

The prostitution scandal attracted international attention after it was reported that Wright had ledgers indicating she made $150,000 over 18 months and had more than 150 clients, some of them prominent.

Both Strong and Wright have pleaded not guilty. Wright will be tried later for dozens of charges that include prostitution and tax violations.

US Senate panel backs Lew nomination for Treasury

(AP) ? The Senate Finance Committee has approved President Barack Obama's choice of Jacob Lew to be Treasury secretary.

Lew would succeed Timothy Geithner, who completed a tumultuous four-year term in which he helped lead the administration's response to the financial crisis and recession. Lew previously served as Obama's budget director and chief of staff.

The committee approved Lew, 19-5. The nomination now goes to the full Senate. The timing of a Senate vote is unclear.

In the hearing, the sharpest questions came from Republicans who pressed Lew about his tenure at Citigroup, where he was a top executive from 2006 until early 2009, a period covering the height of the financial crisis. Lew was grilled about a nearly $1 million bonus he received while Citi was being bailed out by taxpayers.

Anti-gun Democrat shoo-in to replace Jackson Jr.

CHICAGO (AP) ? Former Illinois legislator Robin Kelly captured the Democratic nomination Tuesday in the race to replace disgraced ex-U.S. Rep. Jesse Jackson Jr., after a truncated campaign season where she got a boost from New York City Mayor Michael Bloomberg's super PAC.

The nomination all but assures that Kelly will sail through the April 9 general election and head to Washington, because the Chicago-area district is overwhelmingly Democratic.

From a crowded field of Democratic contenders, Kelly emerged early as a leader on gun-control issues ? a central theme during the race ? which helped her win support from Bloomberg's super PAC, Independence USA. It poured more than $2 million into the race by airing anti-gun ads in her favor and against another Democratic front runner, former U.S. Rep. Debbie Halvorson, who unlike Kelly is against banning assault weapons.

"We worked really, really hard," the former state representative from Matteson, a south Chicago suburb, told The Associated Press. "We were on the right side of the issue and our message resonated."

Kelly also defended the financial support from Bloomberg, saying: "No one complains when the NRA was spending big money." In her victory speech she vowed to fight for gun control until "gun violence is no longer a nightly feature on the evening news."

Halvorson conceded Tuesday evening, saying the outside money certainly played a role.

"It shows, unfortunately, you can't go up against that big money. ...That's the problem with super PACs," Halvorson, who unsuccessfully challenged Jackson in a primary last year, told the AP. "There is nothing I could have done differently."

After casting her ballot earlier in the day, in the snowy weather that pelted the region Tuesday, Halvorson had warned that if the ads were successful, Bloomberg would try to "buy seats" across the country.

Another Democratic front runner, Chicago Alderman Anthony Beale, also took issue with the ads, saying people were "extremely upset" that someone from New York was trying to tell people in Illinois how to vote.

"That's what money gets you," he told the AP after conceding late Tuesday. "We earned every vote."

Bloomberg called Kelly's win an important victory for "common sense leadership" on gun violence, saying in a statement that voters nationwide are demanding change from their leaders. His PAC, launched weeks before the November election, has spent more than $12 million backing candidates nationwide.

Meanwhile, the race among the Republican candidates, all lesser known, was too close to call Tuesday night.

Guns were a leading issue at candidate forums and email blasts from candidates, even as Jackson's legal saga played out in court and frustrated voters who've seen two other congressmen in the office leave under an ethical or legal cloud.

Jackson resigned in November, after a months-long medical leave for treatment of bipolar disorder and other issues, then pleaded guilty earlier this month to charges that accused him of misspending $750,000 in campaign money on lavish personal items, including a Rolex watch and fur coats.

Jackson's exit created a rare opening in a district where he was first elected in 1995. The primary featured 14 Democrats, including former U.S. Rep. Mel Reynolds, who held the seat in the 1990s but served prison time after being convicted of fraud and for having sex with an underage campaign volunteer. There were four Republicans on the ballot.

Voters heading to the polls Tuesday indicated that guns, ethics and economic woes were on their minds. Attention to the gun-control debate came as Chicago experienced a spike in homicides last year and was reignited in the wake of the school shooting in Connecticut.

Mary Jo Higgins of south suburban Steger said she voted for Halvorson because the former congresswoman is "the only Democrat who believes in the Second Amendment."

But Country Club Hills minister Rosemary Gage said she voted for former state Rep. Robin Kelly because Kelly is "standing with (President Barack Obama) and trying to get rid of guns."

"It's really bad in Chicago and across the country," Gage said. "Too many children have died."

The issue of ethics was also on the minds of voters, particularly as Jackson's legal saga has been playing out in federal court. David Berchem, a retired painter, said he voted for Halvorson because he believes she would represent all residents of the district and was "as honest a person as you can find."

Beale voted at a school in Chicago, while Kelly voted early.

Beale touted his record as a job creator for the South Side ward he represents in Chicago's City Council. That's the reason Juanita Williams, who went to school with Beale, voted for him Tuesday, saying he helped bring a Wal-Mart to the area. The 47-year-old assistant teacher also said Beale has regularly provided school supplies and Christmas gifts to needy students.

Election officials in the three counties making up the district reported few problems at the polls, even though voters and poll workers had to contend with a blustery mix of snow and sleet. Chicago's Department of Streets and Sanitation deployed extra resources to keep polls accessible.

Turnout at the polls was low, approximately 14 percent district wide. Election officials said the weather might have kept some voters on the fence at home.

The ?Unsinkable? Titanic II

Let?s hope the Titanic II ocean liner doesn't end up like the original.

The Australian billionaire Clive Palmer, who is financing plans for the replica luxury liner, unveiled blueprints for the ship that will be built in China and have its maiden voyage in 2016 to chart the course of the original Titanic from Southampton, England, to New York City ? minus the iceberg.

Palmer said, ?The area [for] passengers will be authentic with the same design and facilities. But there will be modern things such as air conditioning and other features we are debating - such as internet on the ship.? Costumes inspired by the 1920s will even be provided. And, yes, enough life boats for everyone.

For "Titanic" movie fans (looking at you, preteen girls), the ship will be designed to make passengers feel like they?re extras in the movie. Minus the last part. (The actual Titanic, just as the one in the James Cameron film, sank en route to New York after hitting an iceberg on April 15, 1912.)

Palmer wouldn?t jinx the project, saying at a press conference, ?I'm not too superstitious ... Anything will sink if you put a hole in it. I think it would be very cavalier to say it.?

And passengers can rest easy: the Finnish shipbuilder behind the reconstruction says it will be the "safest cruise ship in the world. " What could possibly go wrong?

Twitter had some ideas. News of the Titanic II plans quickly caught the attention of the social media site, making the ship a trending topic. Martin ?@MartinComedyy posted, ?Titanic II...is there going to be an Iceberg II??

The Carnival cruise ship Triumph, a 14-story luxury liner carrying 4,200 passengers and crew, in February lost power to propulsion, refrigeration, generators, and yes, toilets, after a fire in the engine room turned a pleasure cruise into a five-day nightmare of spoiled food and nonworking toilets.

A lawsuit filed on behalf of passenger Cassie Terry described the situation as ?the voyage of the damned,? adding that Terry ?was forced to subsist for days in a floating toilet, a floating Petri dish, a floating hell.?

Apple signals emerging-market rethink with India push

NEW DELHI/BANGALORE (Reuters) - As BlackBerry launches the first smartphone from its make-or-break BB10 line in India, one of its most loyal markets, the company faces new competition from a formidable rival that has long had a minimal presence in the country.

More than four years after it started selling iPhones in India, Apple Inc is now aggressively pushing the iconic device through installment payment plans that make it more affordable, a new distribution model and heavy marketing blitz.

"Now your dream phone" at 5,056 rupees ($93), read a recent full front-page ad for an iPhone 5 in the Times of India, referring to the initial payment on a phone priced at $840, or almost two months' wages for an entry-level software engineer.

The new-found interest in India suggests a subtle strategy shift for Apple, which has moved tentatively in emerging markets and has allowed rivals such as Samsung and Blackberry to dominate with more affordable smartphones. With the exception of China, all of its Apple stores are in advanced economies.

Apple expanded its India sales effort in the latter half of 2012 by adding two distributors. Previously it sold iPhones only through a few carriers and stores it calls premium resellers.

The result: iPhone shipments to India between October and December nearly tripled to 250,000 units from 90,000 in the previous quarter, according to an estimate by Jessica Kwee, a Singapore-based analyst at consultancy Canalys.

At The MobileStore, an Indian chain owned by the Essar conglomerate, which says it sells 15 percent of iPhones in the country, iPhone sales tripled between December and January, thanks to a monthly payment scheme launched last month.

"Most people in India can't afford a dollar-priced phone when the salaries in India are rupee salaries. But the desire is the same," said Himanshu Chakrawarti, its chief executive.

Apple, the distributors, retailers and banks share the advertising and interest cost of the marketing push, according to Chakrawarti. Carriers like Bharti Airtel Ltd, which also sell the iPhone 5, run separate ads.

India is the world's No. 2 cellphone market by users, but most Indians can't afford fancy handsets. Smartphones account for just a tenth of total phone sales. In India, 95 percent of cellphone users have prepaid accounts without a fixed contract. Unlike in the United States, carriers do not subsidize handsets.

Within the smartphone segment, Apple's Indian market share last quarter was just 5 percent, according to Canalys, meaning its overall penetration is tiny.

Still, industry research firm IDC expects the Indian smartphone market to grow more than five times from about 19 million units last year to 108 million in 2016, which presents a big opportunity.

Samsung Electronics dominates Indian smartphone sales with a 40 percent share, thanks to its wide portfolio of Android devices priced as low as $110. The market has also been flooded by cheaper Android phones from local brands such as Micromax and Lava.

Most smartphones sold in India are much cheaper than the iPhone, said Gartner analyst Anshul Gupta.

"Where the masses are - there, Apple still has a gap."

'I LOVE INDIA, BUT...'

Apple helped create the smartphone industry with the iPhone in 2007. But last year Apple lost its lead globally to Samsung whose smartphones, which run Google's free Android software, are especially attractive in Asia.

Many in Silicon Valley and Wall Street believe the surest way to penetrate lower-income Asian markets would be with a cheaper iPhone, as has been widely reported but never confirmed. The risk is that a cheap iPhone would cannibalize demand for the premium version and eat into Apple's peerless margins.

The new monthly payment plan in India goes a long way to expanding the potential market, said Chakrawarti.

"The Apple campaign is not meant for really the regular top-end customer, it is meant to upgrade the 10,000-12,000 handset guy to 45,000 rupees," he said.

Apple's main focus for expansion in Asia has been Greater China, including Taiwan and Hong Kong, where revenue grew 60 percent last quarter to $7.3 billion.

Asked last year why Apple had not been as successful in India, Chief Executive Tim Cook said its business in India was growing but the group remained more focused on other markets.

"I love India, but I believe that Apple has some higher potential in the intermediate term in some other countries," Cook said. "The multi-layer distribution there really adds to the cost of getting products to market," he said at the time.

Apple, which has partly addressed that by adding distributors, did not respond to an email seeking comment.

Ingram Micro Inc, one of its new distributors, also declined comment. Executives at Redington (India) Ltd, the other distributor, could not immediately be reached.

BlackBerry, which has seen its global market share shrivel to 3.4 percent from 20 percent over the past three years, is making what is seen as a last-ditch effort to save itself with the BB10 series.

The high-end BlackBerry Z10 to be launched in India on Monday is expected to be priced not far from the 45,500 rupees price tag for an iPhone 5 with 16 gigabytes of memory. Samsung's Galaxy S3 and Galaxy Note 2, Nokia's Lumia 920 and two HTC Corp models are the main iPhone rivals.

Until last year, Blackberry was the No. 3 smartphone brand in India with market share of more than 10 percent, thanks to a push into the consumer segment with lower-priced phones. Last quarter its share fell to about 5 percent, putting it in fifth place, according to Canalys. Apple was sixth.

Hathaway, Waltz win supporting-acting Oscars

LOS ANGELES (AP) ? Anne Hathaway has gone from propping up leaden sidekick James Franco at the Academy Awards to hefting a golden statue of her own with a supporting-actress Oscar win as a doomed mother-turned-prostitute in the musical "Les Miserables."

Christoph Waltz won his second supporting-actor Oscar for a Tarantino film, this time as a genteel bounty hunter in the slave-revenge saga "Django Unchained."

Hathaway, whose perkiness helped carry her and the listless Franco through an ill-starred stint as Oscar hosts two years ago, is the third performer in a musical to win supporting actress during the genre's resurgence in the last decade.

"It came true," said Hathaway, who joins 2002 supporting-actress winner Catherine Zeta-Jones for "Chicago" and 2006 recipient Jennifer Hudson for "Dreamgirls." Hathaway had warm thanks for "Les Miz" co-star Hugh Jackman, with whom she once sang a duet at the Oscars when he was the show's host.

Hathaway's Oscar came for her role as noble but fallen Fantine in the big-screen adaptation of the Broadway smash that was based on Victor Hugo's epic novel of revolution, romance and redemption in 19th century France.

In a choked voice, Waltz offered thanks to his character and "to his creator and the creator of his awe-inspiring world, Quentin Tarantino."

Waltz also offered gracious thanks to his supporting-actor competitors, who included two-time Oscar winner Robert De Niro and Oscar recipient Tommy Lee Jones, who had been considered a slim favorite over Waltz for the prize.

A veteran performer in Germany and his native Austria, Waltz had been a virtual unknown in Hollywood when Tarantino cast him as a gleefully evil Nazi in 2009's "Inglourious Basterds," which won him his first Oscar.

Waltz has since done a handful of other Hollywood movies, but it's Tarantino who has given him his two choicest roles. Backstage, Waltz had a simple explanation for why the collaboration works.

"Quentin writes poetry, and I like poetry," Waltz said.

The foreign-language prize went to Austrian filmmaker Michael Haneke's old-age love story "Amour," which had been a major surprise with five nominations, including picture, director and original screenplay for Haneke and best actress for Emmanuelle Riva, who turned 86 on Sunday and would be the oldest acting winner ever.

The top prize winner at last year's Cannes Film Festival, "Amour" follows the agonizing story of an elderly man (Jean-Louis Trintignant) tending his wife (Riva) as she declines from age and illness.

Haneke thanked his own wife for supporting him in his work for 30 years.

"You are the center of my life," Haneke said.

The Scottish adventure "Brave," from Disney's Pixar Animation unit, was named best animated feature. Pixar films have won seven of the 12 Oscars since the category was added.

"I just happen to be wearing the kilt," said "Brave" co-director Mark Andrews, who took the stage in his trademark Scottish garment.

The upbeat musical portrait "Searching for Sugar Man" took the documentary feature prize. The film follows the quest of two South African fans to discover the fate of acclaimed but obscure singer-songwriter Sixto Rodriguez, who dropped out of sight after two albums in the 1970s and was rumored to have died a bitter death.

"Thanks to one of the greatest singers ever, Rodriguez," said "Sugar Man" director Malik Bendjelloul.

There was a rare tie in one category, with the Osama bin Laden thriller "Zero Dark Thirty" and the James Bond tale "Skyfall" each winning for sound editing.

Oscar host Seth MacFarlane opened with a mildly edgy monologue that offered the usual polite jabs at the academy, the stars and the industry. He took a poke at academy voters over the snub of Ben Affleck, who missed out on a directing nomination for best-picture favorite "Argo," a thriller about the CIA's plot to rescue six Americans during the Iranian hostage crisis.

"The story was so top secret that the film's director is unknown to the academy," MacFarlane said. "They know they screwed up. Ben, it's not your fault."

William Shatner made a guest appearance as his "Star Trek" character Capt. James Kirk, appearing on a giant screen above the stage during MacFarlane's monologue, saying he came back in time to stop the host from ruining the Oscars.

"Your jokes are tasteless and inappropriate, and everyone ends up hating you," said Shatner, who revealed a headline supposedly from the next day's newspaper that read, "Seth MacFarlane worst Oscar host ever."

The performance-heavy Oscars also included an opening number featuring Charlize Theron and Channing Tatum, who did a classy dance while MacFarlane crooned "The Way You Look Tonight." Daniel Radcliffe and Joseph Gordon-Levitt then joined MacFarlane for an elegant musical rendition of "High Hopes."

Oscar producers Craig Zadan and Neil Meron lined up a top-notch cast of stars as presenters, including "The Avengers" co-stars Robert Downey Jr., Samuel L. Jackson, Chris Evans, Mark Ruffalo and Jeremy Renner. They presented two prizes that went to the shipwreck tale "Life of Pi," cinematography and visual effects.

"Life of Pi" also won for Mychael Danna's multicultural musical score that blends Indian and Western instruments and influences.

"I share this wondrous award with our visionary captain, Mr. Ang Lee," Danna said of the film's director.

Halle Berry introduced a tribute to the Bond franchise, in which she has co-starred, as the British super-spy celebrated his 50th anniversary on the big-screen last year with the latest adventure "Skyfall." Shirley Bassey sang her theme song to the 1960s Bond tale "Goldfinger." Later, pop star Adele performed her theme tune from "Skyfall," which won the best-song Oscar.

Barbra Streisand injected some musical sentiment into the show's segment memorializing Hollywood figures who died in the past year as she sang "The Way We Were," the Oscar-winning song she did in the film of the same name.

A salute to the resurgence of movie musicals in the last decade included Oscar winners Zeta-Jones singing "All That Jazz" from "Chicago" and Hudson doing "And I Am Telling You I'm Not Going" from "Dreamgirls." Hathaway and Jackman joined cast mates of best-picture contender "Les Miserables" to sing songs from their musical.

Academy officials said all performances were sung live.

Fans had pondered how far MacFarlane the impudent creator of "Family Guy," might push the normally prim and proper Oscars. MacFarlane was generally polite and respectful, showcasing his charm, wit and vocal gifts.

MacFarlane did press his luck a bit on an Abraham Lincoln joke, noting that Raymond Massey preceded "Lincoln" star Daniel Day-Lewis as an Oscar nominee for 1940's "Abe Lincoln in Illinois."

"I would argue that the actor who really got inside Lincoln's head was John Wilkes Booth," MacFarlane wisecracked, earning some groans from the crowd. "A hundred and 50 years later, and it's still too soon?"

Affleck's "Argo" looks like it will be an uncommon film to claim best picture without a directing nomination, while "Lincoln" filmmaker Steven Spielberg and star Day-Lewis are favored to join exclusive lists of three-time Oscar winners.

"Lincoln" won for production design, while "Argo" won for film editing.

Affleck was not counting on anything, though.

"We don't expect to depart with anything but our integrity," Affleck said before the show.

"Argo" has won winning practically every top prize at earlier honors. Hollywood was shocked that Affleck was snubbed for a directing nomination, possibly earning the film some sympathy votes, particularly from actors, who love it when one of their own succeeds behind the camera.

The story of how Hollywood, Canada and the CIA teamed up to rescue six Americans during the Iranian hostage crisis, "Argo" would become just the fourth film in 85 years to claim the top prize without a best-directing nomination and the first since 1989's "Driving Miss Daisy."

Kids With Ear Infections May Not Need Antibiotics, New Guidelines Say

Young children with ear infections don't necessarily need antibiotic treatment right away. In fact, they may not need the medication at all, according to new guidelines from an influential group of doctors.

Children ages 6 months to 2 years with an infection in one ear who don't have a high fever, severe pain or other complications can be watched for 48 hours without antibiotic treatment to see if the infection gets worse, the guidelines say. The same watching period applies to older children with a mild infection in one or both ears.

The new guidelines, from the American Academy of Pediatrics, are intended to reduce unnecessary use of antibiotics. While previous guidelines from the AAP proposed a watching period for older children with mild ear infections, the new guidelines are more specific about how to diagnose infections and include younger children.

The guidelines specifically discuss recommendations for acute otitis media, or infections or inflammation of the middle ear, the most common type of ear infection, and the most common reason U.S. kids receive antibiotics, the AAP says. The AAP also recommends against the use of antibiotics to prevent future ear infections in kids who frequently get such infections.

"We do believe there's overuse of antibiotics in the community," said Dr. Andres Orjuela, an ear, nose and throat specialist at Miami Children's Hospital, who was not involved in developing the new recommendations.? The new guidelines are a helpful tool for instructing physicians on how to go about diagnosing and treating ear infections, Orjuela said.

Studies show that often, kids with a mild ear infectios will get better without antibiotics within a few days, and delaying treatment doesn?t have repercussions for the child, Orjuela said. Painkillers such as ibuprofen or acetaminophen can help with pain.

However, some kids will need antibiotics, including young children who have an infection in both ears, and all kids whose symptoms persist for more than 48 hours. Doctors who take a "wait and see" approach to treating ear infections need to be sure the child can be reevaluated within a few days, and provide treatment if necessary, Orjuela said.

A 2007 study found that physicians were hesitant to delay the use of antibiotics for ear infections, most commonly because they said parents were reluctant to accept this approach. The new guidelines say the decision about whether or not to delay the use of antibiotics in kids with a mild ear infection should be made in partnership with the parents. The 2007 study suggested providing parents with antibiotics to give to their children only if their symptoms didn't go away, but noted that this strategy places more responsibility in the hands of parents and may not be suitable for everyone.

The new recommendations are published today (Feb. 25) in the journal Pediatrics.

Intel announces dual-core Atom, multiband LTE chip and OEM partnerships

Intel is laying down a whole group of announcements today, covering the launch of dual-core Atom processors, multiband LTE chips and partnerships with OEMs for future quad-core Intel chips. First up is Intel's dual-core Atom (known as Clover Trail+), which is a 32nm (nanometer) processor coming in three SKU's -- Z2580, Z2560, Z2520 -- at 2.0GHz, 1.6GHz and 1.2GHz, respectively. The new Atom will deliver "industry-leading" performance, with Intel's hyper-threading technology, and battery life (which hasn't been Intel's strong suit) to rival current high-end devices.

The new chips also now support up to 1900x1200 display resolution, which will make it a suitable chip for future Android tablets. The Clover Trail+ Atoms support Android 4.2 Jelly Bean and HSPA+ 42 mobile data modems as well. Intel says it has already made partnerships with ASUS, Lenovo and ZTE to integrate Clover Trail+ processors into future tablets and phones.

Intel is also announcing today the availability of its first multimode and multiband LTE chip, the XMM 7160. One of the world's lowest power and smallest chips available, the 7160 supports up to 15 LTE bands simultaneously, and offers full LTE, DC-HSPA+ and EDGE connectivity in one chip SKU. Intel expects the radio to be ready in the first half of this year, with the radio and processor roadmaps soon converging to offer an integrated solution in the future.

Last but not least, Intel is looking forward to its upcoming "Bay Trail" quad-core Atom processors for use in tablets. The new processor will double the performance of its current tablet offerings, with potential designs as small as 8nm going forward. Intel is working with Acer, ASUS, HP, Lenovo, LG Electronics and Samsung to have both Android and Windows 8 tablets in the market by the holiday season of 2013 with Bay Trail quad-core processors.

Things weren't too great for Intel in 2012 when looking at the complete dominance of ARM-based processors in high-end devices, but the company doesn't seem to be holding back on its mobile product developments. Give it a couple more product cycles and Intel could begin to see some market share gain going forward.

Battle for Syria's Aleppo airport intensifies

BEIRUT (AP) ? The battle for Syria's second-largest airport intensified on Saturday as government troops tried to reverse recent strategic gains the rebels have made in the northeast in their quest to topple President Bashar Assad.

Assad's forces have been locked in a stalemate with rebels in Aleppo since July when the city, the largest in Syria, became a major battlefield in the 2-year-old conflict the United Nations says has killed at least 70,000 people. Rebels have been trying to capture the international airport for months.

Rami Abdul-Rahman, director of the Britain-based activist group Syrian Observatory for Human Rights, said the current fighting was focused on a section of a highway linking the airport with Aleppo, the commercial hub of the nation.

The rebels have cut off the highway, which the army has been using to transport troops and supplies to a military base within the airport complex. Rebels have made other advances in the battle for the complex in recent weeks, including capturing two army bases along the road to the airport.

The rebels also control large swaths of land outside Aleppo and whole neighborhoods inside the city, which is divided between areas controlled by the regime and others held by rebels. On Saturday, the army launched an offensive on opposition strongholds outside Damascus in an effort to dislodge rebels from areas around the capital that they have been trying to storm for weeks.

On Friday, regime forces fired three missiles into a rebel-held area in eastern Aleppo, hitting several buildings and killing 29 people, according to the Observatory. The group initially reported 14 casualties in the strike that apparently involved ground-to-ground missiles. Some bodies were recovered from the rubble of damaged buildings.

Recent rebel advances in the Damascus suburbs, combined with the bombings and three straight days of mortar attacks earlier this week marked the most sustained challenge to the heart of the capital, the seat of Assad's power.

A suicide car bombing on Thursday near the ruling Baath Party headquarters in the heart of Damascus killed 53 civilians and wounded more than 200, according to state media. Anti-regime activists put the death toll at 61, which would make it the deadliest bombing of the revolt in the capital.

The different tolls could not be reconciled.

Nobody claimed responsibility for the attack. Car bombs and suicide attacks have been a hallmark of Jabhat al-Nusra, an Islamic militant group fighting among the rebels. Nusra fighters, the most effective group on the battlefield, have led assaults on military installations and control swaths of territory in the north, including parts of Aleppo neighborhoods.

The fighting has increasingly taken on sectarian overtones with members of Syria's Sunni Muslim majority dominating the rebel ranks, who are fighting Assad's regime that is mostly made up of Alawites, an offshoot Shiite group.

Efforts to stop the bloodshed in Syria so far have failed, leaving the international community at a loss of how to end the civil war.

Russia and the Arab League proposed on Wednesday to broker talks between the Syrian opposition and Assad's regime in Moscow, one of Damascus' closest allies. Syrian Foreign Minister Walid al-Moallem will lead a delegation to Moscow on Monday, and Russia had been expecting a visit in March from opposition leader Mouaz al-Khatib.

Russian Foreign Minister Sergey Lavrov said the Kremlin and the Arab League were trying to establish direct contact between the Syrian regime and the opposition. The Western-backed opposition umbrella group, the Syrian National Coalition, has rejected any talks as long as Assad remains in power.

In a sharp turnaround, al-Khatib said earlier this month he'd meet with members of the regime if that would help end the bloodshed. His comments, however, drew sharp criticism from several opposition figures who said al-Khatib spoke for himself, not the group.

The Coalition said in a statement posted on its Facebook page late Friday that its leaders would not travel to Washington or Moscow for any talks. The coalition said the decision was taken to protest the international community's "silence over crimes committed by the regime" against Syrian people in Aleppo and other cities across the country.

The statement also said that the opposition leaders would boycott a meeting next month in Rome of the Friends of Syria, which includes the United States and its European allies.

Some Off-Shore Oil Rigs Have Been "Incapacitated" By Malware Thanks To Pirated Music and Porn Hacks have been popping up all over the place recently. Facebook, Microsoft, Twitter, various news organizations. And off-shore oil rigs aren't to be left out. According to the Houston Chronicle, more than one of the things have been "incapacitated" by malware that can be traced back to the Internet's most common vices: pirated music and porn.

The Chronicle relays reports from unnamed cybersecurity professionals that indicate there are plenty of cases in which these literal islands of Internet disconnection have been infected, "exposing gaps in security that could pose serious risks to people and the environment." Conventional Internet isn't readily available on rigs, but the malware still gets in, sometimes due to satellite downloads, or good old-fashioned USB-drive stashes.

Obviously malware is never a good thing, but experts seem to be worried about infection on rigs in particular as it could lead to something like "a well blowout, explosion, oil spill and lost human lives." And the whole situation is made worse due to the fact that many rigs, apparently, have little to no standards in place to keep malware at bay. One of the professionals described a situation in the gulf coast this way to the Chronicle: "They literally had a worm that was flooding their network, and they're out in the middle of the ocean."

So far there haven't been any real catastrophic events, and chances are the malware that's screwing stuff up is just nuance-grade, gumming up the works. But if something was to be directly targeted at the rigs, things could be much worse. Maybe it's time someone updated that anti-virus software; getting rid of the porn is out of the question. NVIDIA's latest venture in the mobile world, called the 4i, was introduced last week ahead of Mobile World Congress, and fortunately the chipset maker brought the product to Barcelona embedded in a reference phone known as "Phoenix." The 8mm-thick handset, which will find a home in the labs of manufacturers and carriers (as well as the desks of many third-party devs), sports a 5-inch 1080p display, 13MP rear-facing camera, PRISM 2, Chimera, DirectTouch and LTE (we're told that most major bands are included for testing purposes). As it's not geared for general consumer use, so it's not the thinnest, sleekest or best-looking device, and the back doesn't even seem to snap completely shut. Units are being sampled as we speak, and we should expect to see devices hit the market in nine to twelve months. Since it's still pretty early in the process, we weren't able to turn on the phone or benchmark the chipset; the only exception to this rule, as you'll see in the video, was when a rep showed a gaming demo on his particular unit.

While the 4i is the smaller brother of the Tegra 4 family, it's still expected to be quite powerful. The chip, which is designed specifically for smartphones (tablets will take advantage of Tegra 4 instead), features four 28nm Cortex-A9 r4 (beefed-up from the standard A9) cores that can be clocked up to 2.3GHz, 60 GPU cores (compared to 72 on the T4) and an integrated i500 LTE baseband modem. For additional comparison, NVIDIA showed us the two sibling boards side-by-side. It was a terrifying moment which left nearly 1,500 people injured and caused more than ?20 million worth of damage.

But few images have been able to capture just how much every day life was turned upside down following the enormous Russian meteor than this video.

These pictures show young Russian schoolchildren practicing their karate moves on each other in a sports hall, completely unaware that their day was about to be completely transformed.


As they continue with their class in Chelyabinsk, a sudden change of light can be seen through the large windows on the left of the picture.

Seconds later, the windows of the sports hall completely blow out - resulting in the school children running away in complete terror.

Many place their hands to their ears as they run for cover. Their instructors look towards the windows in horror.


It is believed the windows were smashed out after a sonic boom - which was the sound of the shock waves created by the meteor traveling through the air faster than the speed of sound.

The meteor injured nearly 1,500 people and caused widespread property damage in Chelyabinsk on Friday, with health officials yesterday saying that 46 of the injured remain hospitalised.

The debris narrowly missed a direct and devastating hit on the industrial city which has a population of 1.13 million but spread panic through its streets as the sky above lit up with a blinding flash.

Scientists yesterday claimed the meteor is the biggest space rock to have hit earth in more than a century.

The 100,000 tonne rock, measuring around 55 feet in diameter, created a huge hole in a frozen lake when it crashed into the ground.

As it raced through the sky, the 50-foot wide chunk of space rock compressed the air ahead of it, creating the enormous temperatures that meant it exploded in a fireball somewhere between 18 and 32 miles above the ground at around 9.20am local time on Friday.

Although some debris fell to earth, 'whipping up a pillar of ice, water and steam' and creating a 20-foot-wide crater, the damage in nearby towns was actually caused by shockwaves created by the meteor breaking the sound barrier and then exploding.

Scientists have found more than 50 tiny fragments of the meteor, allowing them to uncover information about its contents.

Local residents have been more interested in the black market value of the fragments since the dramatic incident, as a 'gold mine' has been kickstarted for the valuable pieces.

As they search for their own pieces of the meteor, rocks have already been put on the internet for sale, and police are warning all purchasers to prepare for possible fraud.

Paul Chodas of NASA's Near-Earth Object Program Office said: 'We would expect an event of this magnitude to occur once every 100 years.'

He told the Wall Street Journal: 'When you have a fireball of this size we would expect a large number of meteorites to reach the surface and in this case there were probably some large ones.'


Viktor Grokhovsky, who led the expedition from Urals Federal University, said that 53 fragments of the meteor have been plucked from the ice-covered Chebarkul Lake.

He said they are less than a centimeter (half an inch) in size, about 10 per cent iron, and belong to the chondrite type, the most common variation of meteorites found on Earth.

Divers inspecting the lake have found nothing at the bottom, but Mr Grokhovsky said a fragment as large as 50-60 centimeters (20-24 inches) could eventually be found there.

Workers in the city remained busy replacing acres of windows shattered by a powerful shockwave caused by the meteor's strike, which NASA said released 500 kilotons of energy, the power equivalent to more than 30 Hiroshima bombs.

The local governor estimated the damage at 1 billion rubles (?21.5million) and said he hopes the federal government will provide at least half that amount.

On Saturday, divers searched the waters beneath the ice for traces of space rock but surfaced empty handed, leaving some experts questioning whether the hole was indeed formed by a piece of falling debris.
