So at this stage, the principal balance on your mortgage is $160,000 ($180,000 remaining balance after the downpayment minus the $20,000 additional payment on the balance). Your equity now is the present appraised value of your home ($300,000) minus the remaining balance ($160,000). Thus, your equity is $140,000.
If you wanted to borrow $40,000 from your equity for a medical emergency, then you will have to see if that falls within the 80 percent limits of your equity. So your combined mortgage balance should you go through with this loan becomes the original balance ($160,000) plus the home equity loan you wish to take ($40,000). The total then is $200,000 which is less than 80 percent of the current value of your home, making your intended $40,000 home equity loan possible, provided that you meet the lender?s other requirements.
There are two kinds of home equity loans: 1) Fixed Rate Home Equity Loans and 2) Home Equity Lines of Credit (HELOC). While both have differences which we will discuss below, they are similar in the sense that the terms usually range from5to 15 years. They also have to be repaid in full in the event that the property in which they are borrowed against gets sold.
A fixed rate loan is a home equity loan that gives a lump-sum amount to the borrower. This must be paid back over a period of time at a pre-agreed rate of interest which will remain the same over the life of the loan. The interest begins right after the money is released by the bank.
A HELOC is a newer type of home equity loan which works in a similar manner as that of other types of personal loans. Some HELOC lenders even provide their borrowers with a credit card. In this home equity loan, the borrowers are pre-approved for a particular spending limit, allowing them to withdraw money when they need it. The payments per month are varied since the HELOC is tied to the current interest rate. Like a fixed rate loan, the amount must be repaid once the term of the loan expires.

Justices take up heart of health care overhaul law

WASHINGTON (AP) ? The Supreme Court is taking up the key question in the challenge to President Barack Obama's historic health care overhaul: Can the government force people to carry insurance or pay a penalty?
The justices hear extended arguments on that topic Tuesday. It's the linchpin of the law's aim to get medical insurance to an additional 30 million people, at a reasonable cost to private insurers and state governments.
Virtually every American will be affected by the outcome, due this summer in the heat of the presidential and congressional election campaigns.
The administration says Congress has ample authority to impose the requirement that most people carry insurance or pay a penalty. Twenty-six states and a small business group trying to get the law struck down call the insurance requirement an unprecedented power grab by Congress.
They say that not even decades of high court rulings that endorsed an expansive view of congressional authority can support the health care law.
If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.
The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because its most disputed element, the insurance requirement, will provide insurance companies with more premiums from healthy people to cover their increased costs of care.
White House press secretary Jay Carney, traveling Tuesday with Obama in South Korea, reiterated the administration's contention that the health care law is constitutional, noting that the individual mandate provision had support among Republicans. However, Carney said, "The president feels that this is something for the court to decide, not for us to weigh in on directly."
The law also dramatically expands the state-federal Medicaid program for low-income Americans, with the federal government covering almost all the additional costs.

A 19th century law bars tax disputes from being heard in the courts before the taxes have been paid. The law could apply to the health care case because the insurance requirement doesn't kick in until 2014 and any penalties will be paid along with federal income tax on returns due by April 2015.
Solicitor General Donald Verrilli Jr., defending the health law, urged the court to focus on what he called "the issues of great moment" at the heart of the case. The states and the National Federation of Independent Business also want the court to go ahead and decide on the law's constitutionality without delay.
Administration officials involved with the defense and implementation of the health care law, Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius, were in the courtroom Monday. Republican Sen. Jeff Sessions of Alabama and Florida Attorney General Pam Bondi also were in the crowd that filled the courtroom's 400 seats.
Outside the packed courtroom, marching and singing demonstrators on both sides ? including doctors in white coats, a Republican presidential candidate and even a brass quartet ? voiced their eagerness for the court to either uphold or throw out the largest expansion in the nation's social safety net since Medicare was enacted in 1965.
Republican presidential candidate Rick Santorum declared anew that GOP front-runner Mitt Romney has no standing to challenge Obama on the law since Massachusetts passed a somewhat similar version when Romney was governor. "If you really want Obamacare repealed," Santorum said outside the court, "there's only one person who can make that happen."
Later Monday, Romney said again he would repeal the law, calling it an unconstitutional power grab.

As reported by Jim O?Neil in Fierce Online Video, the Roku CEO Anthony Wood gave a keynote address at the OTTCon in San Jose, California, last week. Wood is quoted as making several noteworthy remarks (and I recommend that you read the whole article), but the part that jumped out at me was this:
As the number of channels grow?there are almost 500 on Roku now and a new one is being launched almost every day?viewing has [to] grow. Roku has seen its viewing time increase from six hours a week to 12. And I think it?s going to continue growing until it reaches 35 hours, the average that viewers watch today.
Let me repeat that with emphasis: 500 channels on Roku. Tell me again what you?re missing if you cancel your cable subscription? Actually, I know the answer; major channels such as ESPN and some of the premium channels offer programming that cannot (yet) be matched online. But when people are watching as many hours of over-the-top streaming video as they currently watch of the linear broadcast content, don?t you think that the ESPNs and HBOs of the traditional media might take notice? Clearly, they already are aware and are deep into their own experiments into Internet streaming for their content.
Oh, and HBO Go is indeed one of those 500 channels on Roku already. If I were running a cable or satellite television service, I?d be trying hard to figure out what I?m going to do when my current business falls apart.

Jiovanna Campbell came to the U.S. illegally when she was 3, and stayed except for one childhood trip back to Mexico. That visit is hindering her shot at legal status.

Jiovanna Campbell was 9 when her uncle killed himself.
Beyond her parents, he was the only family she had known since coming illegally to the U.S. at age 3. Her parents sold everything they owned to take his body back to Mexico, she recalled. They stayed for a few months while her parents coped with the death. Then they returned to the Bay Area, crossing the border illegally with others in a car. Campbell finished high school, enrolled in college, married a U.S. citizen and bought a home.
As Campbell prepared to graduate, she felt she couldn?t continue living without legal status in the U.S. Typically, experts say, people like Campbell have a decent shot at getting a visa if they return to their home countries to apply. So, on the advice of a notary public, she went to Mexico to request legal status as the wife of a U.S. citizen.
Once in Ciudad Juarez, Campbell learned that her childhood trip to Mexico meant she would be barred from the U.S. under current immigration laws.
Now she is 24 and seven months pregnant, living in the home of an aunt she barely knows, in a country whose language and medical system she doesn?t completely understand.
Because of a little-known provision in a 1996 immigration law, many people who otherwise would be eligible to legalize their status are prohibited from doing so because they left the country and returned. The ban has been applied to those, like Campbell, who left as children with their families, even for short visits. It also has been applied to teenagers who are otherwise eligible to adjust their status, immigration attorneys said.
Immigrant rights advocates say the law unfairly punishes people for decisions over which they had no control. Recently, the American Immigration Lawyers Assn. attempted to challenge the provision with a brief filed with the Board of Immigration Appeals in a case involving a 17-year-old who would be barred from the country. They say consular officials and others misinterpreted a law that Congress never intended to apply to children.
In the tangle of laws, rules and decisions that make up the country?s immigration system, contradictions and inconsistencies are common, advocates say. Actions by minors are provided various safeguards within the system, including protections from being excluded for juvenile delinquency. But when it comes to having crossed the border, those safeguards disappear.
Campbell ?is the prototypical example of why this is ridiculous,? said Stephen Manning, who co-wrote the brief. ?What is the point that they?re trying to get at? ? If you?re saying you?re trying to get tough on immigrants who are crossing the border illegally, you can?t do that for a 9-year-old.?
Campbell remembers little about the trip that has so affected her life.
?I remember my uncle was going through a hard divorce and he was living with us at the time,? she said. ?I remember seeing ? my dad crying for the first time.?
In Mexico, her father fell into a difficult depression. Her mother enrolled her in a nearby school, where she struggled to keep up, especially when it came to Mexican history. They left after about four months. She was glad to be back in the U.S.
She met Ryan Campbell in high school. Soon after they started dating she told him about her immigration status and asked if it was something he could deal with.
?I loved her,? he said. ?So I couldn?t let anything like that stand in between us.?
She enrolled in community college, then transferred to Cal State Stanislaus to study kinesiology. As graduation approached, she said, ?I just didn?t want to be in the U.S. illegally anymore. I wanted to do things right.?
Campbell talked with a notary public, who explained that despite being in the U.S. illegally, she probably would qualify for a waiver to return to the country as the spouse of a citizen. But she had to apply from Mexico.
?I?ve never worked illegally,? she said. ?I?ve never had a job in the U.S. I?ve never even gotten a ticket. I do community service. I thought my chances were going to be pretty good to be able to get my visa.?
At the consulate in Ciudad Juarez, across the border from El Paso, Texas, a woman asked her several questions, including whether she?d ever left the U.S. Without having the exact dates in front of her, Campbell mistakenly replied that she?d left for a few months when she was 10 years old. At the end of the interview, the woman handed her a paper that said she was ineligible for a visa. Two weeks after the interview she learned she was pregnant.
The ban applies for 10 years.
Campbell sleeps on an aunt?s couch in Toluca, near Mexico City, the nation?s capital. News reports make her fearful of going out alone, so she stays inside, reads ?What to Expect When You?re Expecting? and researches ways to challenge her case. She occasionally visits a local clinic for prenatal care and has begun looking into nearby hospitals to figure out where she might give birth.
?It?s just a very scary thing, thinking that I?d have to be out here for at least 10 years before I?m able to apply for a visa again,? she said. ?We?re doing everything we can to be together and provide a good life for our son. But it would be really difficult to do something like that being in different countries.?
She holds out for one possibility, based on a technicality, that things might change. When she told the consular official that she left the U.S. when she was 10, it meant that she had been in the country illegally for more than a year after the 1996 law went into effect. Because of that, the trip triggered the 10-year ban. She has since found documentation showing she left a year earlier, meaning the ban wouldn?t apply. Consular officials recently promised to review the case.
For many other young immigrants who have crossed the border since the law was passed, there is no such option.
Since Manning, the immigration attorney, filed his brief, at least three people a week have contacted him to say they were in a similar situation.
?The size of the class we?re talking about just keeps growing,? Manning said.
Attorneys expect to get a ruling on the case later this year.

Melissa Gilbert has a good cry while rehearsing with pro Maks on "Dancing."
The judges deemed last week's season premiere the series' "best ever" after two contestants ? Welsh opera singer Katherine Jenkins and a positively dashing Jaleel White ? scored 9s, only six points separated first place from last and the rock-bottom score was a respectable 20.

Anyway, did the stars ? one of whom will go home tomorrow ? start buckling under the pressure tonight?
Well, it certainly wasn't the lovefest that last week was.

Katherine threw her opera-singing, lunching-with-the-queen image of demureness out the window with a jive sexy enough to be declared not Len Goodman's "cup of tea." So, obviously, Bruno Tonioli loved it and he and Carrie Ann Inaba bestowed a pair of 9s on the leggy blonde.
But they weren't the first 9s of the night ? Disney prince Roshon Fegan kicked things off with a quickstep that showed he can do elegant just as well as he brings in the funk.
Joining the upper tier of contestants once again was Bruno's favorite amateur dancer, ever, William Levy ? who was just as adorable doing the quickstep as he was sexy doing the cha-cha.
Jaleel, unfortunately, didn't bring as much bounce to his jive as we expected from the out-of-the-gate fave, and his score suffered. "The Family Matters" star, who pointed out that knocking into doors without getting hurt isn't as easy as it looks, took the biggest dive, score-wise, going from a 26 to a 22.

Maria Menounos headed in the opposite direction, impressing with her quickstep enough for a four-point jump, from 21 to 25.
Sherri Shepherd worried she wouldn't be able to handle the jive ? but she had more bounce than Jaleel! She turned in just as giddy a performance as she did last week, and she once again scored a 23.
But the real surprise came when Len apologized to Donald Driver for "undermarking" him last week. Personally, we kinda think they all undermarked him this week, too, but at least he got a nice bump after a sharp quickstep.
Gavin DeGraw also did way better, energy-wise, than last week indicated he was capable of, but it was a little too sloppy for the judges' taste.

Meanwhile, we're starting to wonder if Melissa Gilbert is being overjudged because she's partnered with the headstrong, itching-to-win Maksim Chmerkovskiy. Last week's cha-cha was very ambitious, and the "Little House on the Prairie" star seemingly rose to the occasion, but she only got a 20.
And she only got 20 this week after a seemingly more-than-competent quickstep! Does she actually stink and we're not seeing it, or are the judges paying extra-special attention to every move they make?
Lucky for Melissa, Martina Navratilova's jive was a bit of a mess. She's fit, she's strong, she looked good ? but she had no attack.
"Aw, that was sad!" Carrie Ann squealed. "Oh, my darling, I think that serve went into the net," lamented Bruno.
